Zwicker & Associates, P.C. has been named as the defendant in a proposed class action that alleges the debt collector violated federal law by failing to clearly communicate the amount of a consumer’s purported debt.
Zwicker & Associates, P.C. has been named as the defendant in a proposed class action that alleges the debt collector violated federal law by failing to clearly communicate the amount of a consumer’s purported debt. The suit claims the man received a collection letter from the defendant informing him of the following:
“As of the date of this letter, you owe $21,853.87.”
The suit argues that this statement falsely suggested the plaintiff’s account was increasing due to interest or other charges and that “immediate payment of the balance would benefit [the plaintiff].” If the account were, in fact, subject to additional charges, the complaint continues, the defendant would not have provided enough information for the plaintiff to calculate the true amount he owed.
