Watch Makers Invicta Clocked with Defective Products Class Action

Invicta Watch Company of America, Inc. are the defendants in a class action claiming the company violated federal and state consumer protection laws by falsely advertising its Pro Diver Series watches. The 20-page complaint claims that the defendant’s Pro Diver Series watches are represented to be suitable for scuba diving and water sports, as well as water resistant from between 50 and 300 meters, but are actually prone to “leakage at any depth and in non-marine situations.”

Specific to the plaintiff, the lawsuit says he wore one of the defendant’s watches in a pool and shortly thereafter discovered condensation forming under the crystal of the watch. Later, rust reportedly developed inside the watch due to water exposure. The lawsuit notes that many consumers online have reported similar problems with the defendant’s product.
