Employees of two gentlemen’s clubs have filed a class action against the establishments and their managers seeking to recover unpaid minimum and overtime wages. The case claims West Virginia-based Vixen’s Gentlemen’s Club and Taboo Gentlemen’s Club engaged in a clear employer-employee relationship with their staff of exotic dancers. Despite this relationship, the suit says, the dancers, as a condition of their employment, were forced to enter into an “Entertainment Licensing Agreement” with the clubs meant to “disavow any employment relationship between them.” The dancers allege in addition to this veiled misclassification, they were also not paid any consistent wages, instead exclusively receiving tips from patrons as compensation.
