A Telephone Consumer Protection Act (TCPA) lawsuit has been filed against United Healthcare Services, Inc. after the defendant allegedly sent consumers unsolicited fax advertisements that didn’t contain required opt-out information. The plaintiff in the case is a Florida doctor’s office that claims it received a fax advertising the defendant’s insurance products and services despite never consenting to receive the message. The suit argues that the fax was missing TCPA-mandated language informing the plaintiff of how to opt-out of receiving future messages, including a fax number and telephone number to which opt-out requests could be sent.
