A Florida man has filed suit against The Berkley Group, Inc. claiming the defendant placed autodialed telemarketing calls to his cell phone 'on many occasions' without his prior consent, an alleged violation of the Telephone Consumer Protection Act.
A Florida man has filed suit against The Berkley Group, Inc. claiming the defendant placed autodialed telemarketing calls to his cell phone "on many occasions" without his prior consent, an alleged violation of the Telephone Consumer Protection Act (TCPA). According to the complaint, the plaintiff demanded that the defendant stop calling him, but to no avail. Notably, the suit mentions the company was named in a similar class action that was settled in the amount of $76 million (Birchmeier, et al. v. Caribbean Cruise Line, Inc., et al., Case No. 12-cv-04069).
