Gorss Motels, Inc. has filed a class action again Magnuson Hotels International, LLC and Magnuson Hotels USA, LLC over violations of the Telephone Consumer Protection Act (TCPA), specifically with regard to the Junk Fax Prevention Act of 2005. The plaintiff claims the defendants sent out numerous unsolicited advertisement faxes that did not contain TCPA-mandated opt out language. The lawsuit alleges at least 40 other recipients received the junk faxes sent by the defendants.
