Dunleavey v. Sunrise Detox Iii, Llc
Filed: December 5, 2018 ◆§ 1:18cv25090
Sunrise Detox III is on the receiving end of a lawsuit that alleges the company sent an unauthorized promotional text to a Miami resident.
Sunrise Detox III, LLC is on the receiving end of a proposed class action filed by a Miami resident who claims the rehabilitation center sent him a promotional text without lawfully obtaining authorization to do so.
The disputed text was allegedly sent to the man in October 2018 and stated: “Hi, this is Sunrise Detox. We are checking to see how you are and if there is any support you need. Call anytime 888-443-3869 Text STOP to end.”
According to the suit, the plaintiff received the telemarketing message despite never having provided the company with his express written consent to be contacted through an automatic telephone dialing system, a violation of the Telephone Consumer Protection Act (TCPA).
