Gorss Motels, Inc. claims in a new proposed lawsuit that defendant Sunbeam Consumer Products is in the habit of sending unsolicited advertisement fax messages in violation of the Telephone Consume Protection Act (TCPA). The case claims the defendant sent junk faxes without express invitation or mandatory opt-out language to at least 40 recipients.
Under the Junk Fax Prevention Act amendment to the TCPA, individuals on the receiving end of unwanted junk faxes may be entitled to up to $500 per violation, the lawsuit says.
