A lawsuit claims the Florida cosmetic surgery group advertises its services by sending spam texts to consumers without consent.
Strax Wellness Center, LLC is the defendant in a proposed class action in which the plaintiff claims the Broward County, Florida cosmetic surgery group sends unsolicited telemarketing text messages to consumers in violation of the Telephone Consumer Protection Act (TCPA). The complaint states the defendant sent the plaintiff automated, short-coded text messages advertising its cosmetic surgery services on at least four different dates between September and December 2016. The messages were sent using TCPA-prohibited technology that allows Strax Rejuvenation to dial or send texts to randomly generated numbers without human intervention, the lawsuit claims.
