A proposed class action lawsuit has been filed against Simon’s Agency, Inc. over claims that the debt collector charged an illegal convenience fee for online payments.
A proposed class action lawsuit has been filed against Simon’s Agency, Inc. over claims that the debt collector charged an illegal convenience fee for online payments. According to the suit, the defendant’s website lists a $3.50 fee if consumers submit payments online. The complaint argues that this extra charge “is neither expressly authorized by the agreement creating the debt, nor permitted by law” and is therefore illegal under the Fair Debt Collection Practices Act.
