A proposed class action citing alleged abuses of the Telephone Consumer Protection Act (TCPA) claims defendant Roar Construction, Inc. unlawfully placed calls to consumers’ cell phones using a prohibited automatic dialing system. The two San Diego County, CA residents who filed the action say they began receiving unauthorized calls in early February 2017. The calls were identical and began with a rather unusual pre-recorded message:
“This message was sent to the plaintiffs’ cellular telephone’s voicemail using a pre-recorded voice. However, this was not a ‘regular’ phone call that was missed and a message left on their voicemail. Instead, both plaintiffs’ phones rang for a split second, or less than half of a regular ring. Then, about 30 seconds later, the plaintiffs were notified that they had a voicemail waiting for them.”
