A proposed class action has been filed in New York against Forster & Garbus, LLP; two of the firm’s attorneys; Navient Solutions, Inc.; Navient Solutions, LLC; and SLM Private Credit Student Loan Trust 2012-C.
A proposed class action has been filed in New York against Forster & Garbus, LLP; two of the firm’s attorneys; Navient Solutions, Inc.; Navient Solutions, LLC; and SLM Private Credit Student Loan Trust 2012-C. The lawsuit alleges that the defendants filed suit against the plaintiff to collect a student loan debt and served him the summons (Exhibit A) on June 21, 2017.
“Exhibit A amounted to a false, deceptive or misleading means in connection with the collection of a debt by F&G, Navient, Garbus, and Forster in violation of [the Fair Debt Collection Practices Act],” the complaint argues.
The suit claims the defendants subjected the plaintiff to an “abusive, deceptive, or misleading” debt collection practice that was unlawful under federal law.
