From Pennsylvania comes a proposed class action filed by a woman who alleges Pep Boys-Manny, Moe & Jack Inc. sold tires to consumers without providing federally required registration forms containing its contact information and the ID number of each tire sold.
According to the 32-page complaint, federal law mandates that each tire sold by independent tire dealers such as the defendant be accompanied with a paper registration form containing the seller’s contact information and the tire’s complete identification number. The purpose for this, the case explains, is so that tire manufacturers can promptly notify consumers in the event of a recall.
The lawsuit argues the defendant’s failure to provide customers with tire registration forms has exposed proposed class members to harm while misrepresenting that their sales practices are in compliance with federal law. Alternatively, consumers, the case continues, are left with the false impression that they can be contacted in the event of a safety-related recall.
