A class action over violations of the Telephone Consumer Protection Act (TCPA) has been filed against Online Information Services, Inc. The lawsuit claims the company used automatic dialing equipment to call the plaintiff’s young daughter’s cell phone about collecting a debt without first receiving express written consent. The plaintiff argues his daughter’s voicemail message, recorded when she was 10 years old, would indicate to any reasonable person that the party being called is a child and not a debtor.
