A proposed class action lawsuit has been filed against Online Information Services, Inc. (which does business as Online Collections) over alleged violations of the Fair Debt Collection Practices Act.

A proposed class action lawsuit has been filed against Online Information Services, Inc. (which does business as Online Collections) over alleged violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff, a New York resident, claims he received a collection notice from the defendant that instructed him to “Please mail payments and correspondence to” a physical address. The suit argues that this statement is misleading to the least sophisticated consumer because it implies that disputes must be submitted in writing and cannot be made over the phone. According to the complaint, the defendant’s demand for written rather than oral disputes is a violation of the FDCPA, which the suit says allows for both.
