Northland Group, Inc. is the defendant in a New York woman’s proposed class action that claims the Minnesota-based company violated the terms of the Fair Debt Collection Practices Act (FDCPA). The defendant allegedly sent the plaintiff a collection notice that demanded payment, yet failed to explain that such a demand does not override one’s rights under the FDCPA.
The complaint argues the defendant’s collection tactics not only overshadow the plaintiff’s right under the FDCPA to seek validation and/or dispute the debt, but to “invoke fear, intimidation and confusion” aimed to make the least sophisticated consumer pay the debt amount rather than invoke her validation rights.
