According to the lawsuit, the TCPA regulates fax advertisements by requiring the recipient’s prior consent to receive the fax. The suit claims the plaintiff, a company that owns and operates pharmacies in Tennessee, received an unsolicited fax from the defendant in March 2018. The plaintiff argues that it did not give prior consent to receive the ad from the defendant, nor did the fax contain a lawful opt-out notice. The lawsuit further alleges that the defendant sent the same and other unsolicited fax advertisements to at least 40 other recipients.
