Forster & Garbus, LLP; LVNV Funding LLC; Sherman Financial Group, LLC; Resurgent Capital Services LP; and two individuals are facing a proposed class action filed by a New York man who alleges violations of the Fair Debt Collection Practices Act (FDCPA). According to the suit, the plaintiff received a court summons from the defendants with the words “consumer credit transaction” at the top of the letter, informing him that the defendants had filed a lawsuit against him. The case claims the letter “amounted to a false, deceptive or misleading means in connection with the collection of a debt,” in violation of the FDCPA.
