A proposed class action filed in Michigan claims Leikin, Ingber & Winters, P.C. unlawfully failed to include federally required language in collection letters notifying consumers that the dispute of debts must be made in writing and that, upon receiving notice of dispute, the debt collection agency must cease collection activities until the debt can be verified. The lawsuit alleges the defendant intentionally left this Fair Debt Collection Practices Act-required language out of collection letters so it could “avoid the cost of validating the debt” and increase profits. Moreover, the defendant’s actions may cause the unsophisticated consumer to not realize he or she has the right to dispute a debt, the lawsuit claims.
