DCH Regional Medical Center, DCH Health Systems, and Avectus Healthcare Solutions, LLC are the defendants in a proposed class action lawsuit filed by an Alabama man who claims they unlawfully failed to submit his medical bills to his health insurance provider and sought to collect the funds through another source. The plaintiff alleges that he was involved in an automobile accident and received medical treatment from the defendants. Rather than sending his medical bills to the plaintiff’s insurance company, and without his prior knowledge, the defendants filed a lien on the plaintiff’s tort claim and illegally collected money from the funds he received in the settlement, the suit says. From the complaint:
“Through Defendants' bill collection practices, they attempt to optimize the amount received for services rendered by seeking from patients the full amount billed (or more than Defendants are entitled to for the covered treatment), rather than accepting the discounted amount it has agreed to accept from the patient's health insurance carrier.”
The plaintiff argues that he has suffered damages by paying health insurance premiums and being unlawfully denied their benefit. He names Blue Cross Blue Shield of Alabama as a nominal defendant in the case.
