Filed: September 19, 2017 ◆§ 2:17-cv-05478
A New York consumer has filed a proposed class action lawsuit against debt collector Richard Sokoloff over claims that he violated the federal Fair Debt Collection Practices Act.
A New York consumer has filed a proposed class action lawsuit against debt collector Richard Sokoloff over claims that he violated the federal Fair Debt Collection Practices Act (FDCPA). The plaintiff says she received a collection letter from the defendant that stated, “Re: John T. Mather Hospital” but failed to note whether the entity was the creditor, original creditor, current creditor, account owner, or creditor to whom the debt is owed. According to the suit, the defendant’s letter fell short of the FDCPA’s requirement that debt collectors clearly identify consumers’ creditors.
