Encarnacion v. Financial Corporation of America
Filed: October 16, 2017 ◆§ 2:17-cv-00566-SPC-CM
A lawsuit claims Financial Corporation of America mailed a consumer a collection notice in which the company did not properly identify the current creditor.
Florida
A Lee County, Florida man claims in a proposed class action that defendant Financial Corporation of America mailed him a collection notice over a medical debt in which the company unlawfully failed to explicitly or implicitly identify his current creditor. The plaintiff claims the defendant’s notice violated the Fair Debt Collection Practices Act (FDCPA), as it left him, the “least sophisticated consumer,” unsure as to on which creditor’s behalf the defendant was attempting to collect the obligation.
