A proposed class action filed in California alleges the SURFBoard SB6190 cable modem sold by defendant Arris International plc contains a “serious” defect that degrades users’ Internet connectivity. The 21-page lawsuit claims Arris advertises its SURFBoard modem to deliver “the fastest speeds and most reliable connection to the Internet” without disclosing alleged “widespread” connectivity issues experienced by consumers.
At the heart of the lawsuit are claims that SURFBoard modem users experienced high spikes in network latency, delays that occur during data communication, which, under normal circumstances, should occur relatively infrequently. Excessive network latency, the complaint continues, can lead to bottlenecks that “prevent data from filling the network pipe” and effectively hamper the network’s overall connection.
The proposed class covered by the lawsuit includes all consumers in California who purchased the defendant’s SURFBoard SB6190 cable modem.
