From Georgia comes a proposed class action alleging payday loan outfit Mississippi Title Loans, Inc. knowingly sent unsolicited marketing text messages to consumers’ cell phones in violation of the Telephone Consumer Protection Act (TCPA). The 13-page complaint alleges the Atlanta-based defendant used automatic telephone dialing technology, banned under the TCPA except for emergency purposes, to send the texts without first receiving prior express consent from recipients.
