Junk Fax Class Action Filed Against BSN Medical

An Ohio chiropractor’s office has filed a proposed class action against BSN Medical, Inc. for allegedly sending out junk faxes in violation of the Telephone Consumer Protection Act (TCPA). According to the complaint, the defendant sent unsolicited faxes to the plaintiff and more than 40 other recipients that did not contain TCPA-mandated opt-out language. Without opt-out language, the suit argues, recipients have no way to stop receiving the unauthorized faxes.
