Jo-Ann Stores, LLC is facing a proposed class action lawsuit filed by a Florida woman who claims the defendant sent her a text message advertisement without obtaining her prior express consent. Alleging violations of the Telephone Consumer Protection Act, the complaint argues that the defendant unlawfully used automating dialing technology to promote its services through text messages sent to consumers who never gave their permission to receive them. The plaintiff says the messages caused her “actual harm,” such as “invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass and conversion,” adding that they were a “disruption to her daily life.”
