The operating entity behind Sanford, Florida-based car dealership Headquarter Hyundai is the defendant in a proposed class action that alleges it invaded consumers’ privacy by placing unsolicited, prerecorded telemarketing phone calls. The complaint alleges defendant Headquarter Auto Group of Central Florida, Ltd., in an attempt to attract new customers, violated the Telephone Consumer Protection Act (TCPA) by placing calls to consumers’ cell phones without first receiving prior express consent. The plaintiff argues that under the precedent set by the landmark Spokeo, Inc. v. Robins ruling, he’s suffered “an invasion of a legally protected interest” and therefore experienced “particularized and concrete” harm allegedly resulting from Headquarter Hyundai’s conduct.
