Global Credit & Collection Corp. is on the receiving end of a proposed class action lawsuit that claims the debt collector misled a consumer regarding her debt amount. Citing potential Fair Debt Collection Practices Act abuses, the lawsuit takes issue with a June 2017 collection letter in which the defendant supposedly referred to the plaintiff’s “current balance”—language that implies the amount may increase—but provided no additional information as to whether her account was accruing interest or fees. Furthermore, the letter allegedly included an itemized list of charges that indicated no interest or fees had been added since charge-off without explaining how much time had passed since the debt was charged off, the suit says.
The letter was deceptive and misleading, according to the lawsuit, because the defendant used language that falsely implied immediate payment would benefit the plaintiff without explicitly informing her as to whether her debt amount was actually increasing.
