F.H. Cann & Associates is the fourth debt collection agency today to be named the defendant in a class action filed over alleged violations of the Fair Debt Collection Practices Act (FDCPA). Filed in New York, the lawsuit claims the company did not identify itself as a debt collector calling about recovering an alleged debt in its communication with the plaintiffs. A debt collector’s failure to disclose the full nature of its call to a debtor, the lawsuit claims, constitutes a violation of the FDCPA.
