Two plaintiffs alleges Forster & Garbus failed to disclose information essential to knowing how much is owed at any given time to resolve their debts.
Two New York consumers allege in a proposed class action case that Forster & Garbus, LLP mailed them collection letters in December 2016 that, while stating additional charges may continue to accrue on their accounts, failed to disclose information essential to knowing how much needs to be paid to resolve the debts at any given point in the future.
“The letters, because of the aforementioned failures, would render the least sophisticated consumer unable to determine the amount of his or her debt,” the complaint asserts, proclaiming the letters violate the Fair Debt Collection Practices Act (FDCPA) in that they effectively do not covey the amounts of debt clearly.
