A class action filed in New York claims Forster & Garbus sent collection letters that failed to note if consumers' balances were subject to interest or fees.
Debt collection agency Forster & Garbus, LLP and its two founders are facing a proposed class action lawsuit filed in New York over alleged Fair Debt Collection Practices Act (FDCPA) violations. The case claims the defendants sent the plaintiff a collection letter for a past due obligation owed to Target that failed to provide proper notice that the full balance may increase due to accruing interest, fees, or late charges. Moreover, the case claims the defendants also failed to clearly state if payment of the “full balance” would result in full satisfaction of the debt.
