Three companies and two individuals who run Mama’s Empanadas locations across New York City are the defendants in a proposed collective action wherein a former cook claims he was not paid mandatory overtime wages.
The plaintiff worked at the defendants’ restaurants in Astoria, Jackson Heights, and Long Island City from January 2010 through June 2018, the lawsuit says. Despite typically working 72 hours per week throughout his employment with defendants Caso Inc., Cario Inc. and Chalana, Inc., the plaintiff claims he was never paid time-and-a-half overtime for all hours worked past 40 each week. The plaintiff was instead paid $7, $7.50 and then $8 per hour in cash across his years with the defendants, the suit alleges.
According to the case, the defendants did not pay the plaintiff any wages at all for roughly one week and one extra day of work.
