Cavalry Portfolio Services, LLC is on the receiving end of a proposed class action lawsuit that claims the debt collector sent a New Jersey man a collection letter that misinformed him of his right to dispute his purported debt. According to the complaint, the letter failed to notify the plaintiff that he must submit any disputes in writing and provided both an address and telephone number for communication purposes. The suit argues that the least sophisticated consumer could be misled into believing he or she could contact the defendant by phone to take advantage of the Fair Debt Collection Practices Act protections concerning disputes when these protections can only be activated through written notification.
