EGS Financial Care is staring down a proposed class action claiming it sent a 'confusing and misleading' collection notice.
A proposed class action filed in Wisconsin claims defendant EGS Financial Care, Inc. violated the federal Fair Debt Collection Practices Act (FDCPA) when it sent the plaintiff a “confusing and misleading” collection notice. The communication in question allegedly noted $234 as the “Amount Now Due” just above stating $2032 as the plaintiff’s “Total Account Balance.” The case claims it is unclear to the plaintiff, i.e. the unsophisticated consumer, whether the defendant is trying to collect the entire $2032 balance or just the $234.
“Whichever number EGS is truly collecting, it need only state that amount in the letter,” the case argues.
