A proposed class action filed in New York alleges defendants ARS National Services Inc. violated the Fair Debt Collection Practices Act (FDCPA) when it failed to disclose in a collection notice whether the plaintiff’s balance owed may increase due to accruing interest and/or fees. The 19-page complaint claims a reasonable consumer may be misled by the defendant’s notice and be left unsure as to whether he or she could satisfy the debt in full by paying the amount listed. Fairly to accurately state the amount of debt owed, as well as failing to disclose whether interest and/or fees may accrue, is considered deceptive and misleading within the meaning of the FDCPA, the case alleges.
