A class action filed on behalf of current and former tipped employees claims the owners and operators of The Riverwinds Restaurant in New Jersey have violated the Fair Labor Standards Act (FLSA) with pay practices. According to court documents, bartenders, servers, bussers, and waitstaff have been systematically denied the federal minimum wage of $2.13 per hour for tipped workers. Plaintiffs also claim the restaurant did not satisfy FLSA requirements to provide employees with notice of tip credit provisions, which were allegedly unlawfully applied against plaintiffs’ wages. Worse, plaintiffs say the defendants frequently took a percentage of contractual tips—paid by customers for parties, luncheons, banquets and similar events—for themselves.
