Northland Group, Inc. is the defendant in another class action claiming the debt collection agency breached the Fair Debt Collection Practices Act (FDCPA). This lawsuit, filed in New Jersey, claims the defendant sent collection letters to proposed class members that included contradicting statements that could cause the unsophisticated consumer to be confused as to what he or she must do to effectively dispute the debt.
The FDCPA calls for collectors to provide debtors, within five days of the initial communication, a 30-day notice to dispute the validity of an alleged debt. In its communication with the plaintiff, the lawsuit argues, the defendant included mandatory validation notice information in the same paragraph as additional, unrelated information, which is considered deceptive to the unsophisticated consumer under the FDCPA.
