A Wisconsin man alleges in a proposed class action that Enhanced Recovery Company, LLC overstepped federal rules governing debt collections. Citing potential Fair Debt Collection Practices Act (FDCPA) violations, the lawsuit claims Enhanced Recovery sent the plaintiff a “contradictory” collection notice offering to settle the man’s debt. More specifically, the defendant’s notice allegedly informed the plaintiff that the company would “reduce [his] outstanding balance by offering a discounted payment amount,” while in another place implied that the man’s remaining balance would still be outstanding after the “offered settlement amount” was paid. The complaint argues the language used by the defendant is false, deceptive and misleading to the least sophisticated consumer.
