Ascena Retail Group, Inc., which does business as Dressbarn, is the defendant in a proposed class action filed over alleged violations of the Telephone Consumer Protection Act (TCPA). The plaintiff alleges in the 10-page lawsuit that Dressbarn used a TCPA-prohibited automatic telephone dialing system to send him and proposed class members text messages that they never consented to receive. The plaintiff, a Pennsylvania resident, claims that no business relationship existed between him and the defendant when he began receiving the nuisance text messages promoting Dressbarn’s “mobile fashion club.”
