Forster & Garbus is the defendant in a class action claiming the debt collector failed to explicitly identify the creditor who's owed payment.
Forster & Garbus, LLP is the defendant in a proposed class action filed by a New York consumer who claims the company mailed him a collection notice in which it failed to explicitly and clearly convey the name of the creditor to which payment is owed. The complaint asserts the mere statement in the notice of “Re: Barclays Bank Delaware” unlawfully fails to indicate whether the entity refers to the account owner, the plaintiff’s current or original creditor, or the institution to whom the man’s debt is owed. Moreover, the lawsuit argues the defendant’s letter, sent in September 2017, also does not indicate who placed the plaintiff’s account with Forster & Garbus, nor does it state who the defendant represents. Such conduct, the lawsuit alleges, violates the Fair Debt Collection Practices Act (FDCPA), as the least sophisticated consumer “would likely be deceived in a material way by the letter.”
