A Suffolk County, New York woman claims in a proposed class action that defendant ARS National Services, Inc. sent her a collection notice that failed to disclose whether her balance owed may increase due to accruing interest and fees. The complaint, which details alleged violations of the Fair Debt Collection Practices Act (FDCPA), argues that the least sophisticated consumer could be reasonably misled by the defendant’s conduct, specifically with regard to whether payment of the stated balance owed would fully satisfy the debt.
