Romero v. Darden Restaurants, Inc.
Filed: May 31, 2017 ◆§ 0:17-cv-61098-MGC
A proposed class action out of Florida claims Darden Restaurants, Inc. has allegedly fallen into the practice of printing too much customer information on receipts.
A proposed class action out of Florida claims that despite having already been sued over purported credit card receipt-related Fair and Accurate Credit Transactions Act (FACTA) violations, defendant Darden Restaurants, Inc. has allegedly, once again, fallen into the practice of printing a bit too much customer information on payment receipts. Claiming the defendant is “once again in willful, knowing, and reckless disregard” of the law, the lawsuit alleges the restaurant operating company, with more than 1,500 popular subsidiaries under its watch, unlawfully printed the expiration date of the plaintiff’s credit card on an electronically printed receipt.
“Because [the defendant] prints the full expiration date on the credit card receipt, any person, including a would-be identify thief, can readily discern whether the card is still active and valid, thereby allowing identity thieves to narrow their focus to more ‘viable’ targets,” the suit argues.
According to the case, the defendant was named in a lawsuit posing similar allegations in Illinois back in 2007.
