A consumer alleges in a proposed class action that Discover Bank and Kohn Law Firm S.C. ran afoul of federal and state debt collection laws by publicly filing “highly confidential and statutorily protected” consumer reports for many Wisconsin consumers in state circuit courts as part of the parties’ collection activities. The plaintiff argues the defendants violated the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA) in that the parties’ “egregious” practice of impermissibly using consumer reports goes against “exactly what Congress intended to prevent with its enactment” of the aforementioned statutes.
The defendants reportedly sued the plaintiff in May 2017 to recover a nearly $5,000 credit card debt. While submitting evidence for that case, the defendants allegedly unlawfully attached a document noting the plaintiff’s credit score, which this lawsuit claims is a violation of federal law.
