Class Action Lawsuit Claims Behr’s Paint & Primer In One Products Do Not Work As Advertised
Gurkov et al v. Behr Process Corporation
Filed: March 11, 2019 ◆§ 2:19cv1383
A class action alleges Behr Process Corporation's Paint & Primer In One product cannot adequately cover a surface in one coat without separately applying primer.
A class action lawsuit out of New York alleges Behr Process Corporation’s Paint & Primer In One products do not work as advertised. The two consumers behind the 30-page lawsuit claim the products, which come in Behr Premium Plus, Behr Premium Plus Ultra, and Behr Marquee varieties, cannot adequately cover and adhere to a surface without first separately applying primer, nor cover the surface in just one coat.
According to the lawsuit, Behr’s claims about the product’s capabilities effectively forced consumers to “incur additional money, time and effort in order to achieve a properly painted surface.”
The lawsuit looks to cover a proposed class of consumers nationwide who bought any of Behr’s Paint & Primer In One products during the to-be-defined class period.
