GC Services Limited Partnership is the defendant in a New York consumer’s proposed class action that takes issue with an allegedly “misleading” letter sent by the debt collector.
The plaintiff claims she received a collection notice from the defendant in January 2018 regarding a debt owed to Citibank. The letter supposedly listed a “New Balance” of $790.99 and a “Minimum Payment Due” of $326.00. According to the suit, the plaintiff’s account with Citibank was closed and charged off in October 2017, meaning there was no minimum payment due because the entire balance was “due and owing.”
The letter also stated, in part:
“Because of interest, late charges, and other charges that may vary from day to day, the amount owed on the day you pay may be greater.”
The case argues the letter misrepresented the plaintiff’s amount of debt since the obligation was not, in fact, accruing interest.
