A new class action lawsuit filed in New York claims debt collection agency Gatestone & Co. sent letters containing “inconsistent statements,” a violation of the Fair Debt Collection Practices Act (FDCPA), to debtors. Gatestone & Co. allegedly sent the plaintiff an itemized letter for a debt of $2,039.09. Next to the line detailing “Total due as of charge-off,” “512094600640” was written. According to the complaint, this inconsistency could be confusing to the unsophisticated consumer, since the FDCPA requires collectors to unambiguously state the amount of debt owed.
