A proposed class action has been filed against Reliant Capital Solutions, LLC by a consumer who claims the debt collector falsely stated that her debt amount was increasing. According to the complaint, the plaintiff received a collection letter from the company informing her that “[b]ecause of interest, late charges, and other charges that may vary from day to day,” the balance of her alleged student loan debt may be higher by the time she makes a payment. The case argues that neither the debt collector nor the woman’s creditor has the authority to “legally or contractually impose” late charges or “other charges” on her debt. Therefore, the complaint continues, the defendant’s statement in the letter was “materially false, deceptive, and misleading” in that it implied the plaintiff would need to pay an additional “undisclosed sum of money” after remitting the amount listed in the letter.
