A New York man has filed a proposed class action against LTD Financial Services, LP over alleged violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff contends the defendant, among other alleged FDPCA abuses, engages in the practice of calling and leaving messages for consumers in which it fails to provide meaningful disclosure that the call is coming from a debt collector attempting to collect a debt.
“Defendant LTD Financial Services, LP as a matter of pattern and practice, leaves anonymous telephone messages for consumers which in effect trick consumers into calling back and being forced to communicate with the debt collector,” the lawsuit argues.
