Zotec Partners is the defendant in a proposed class action in which the plaintiff claims the company violated state and federal debt collection laws.
Zotec Partners, LLC is the defendant in a proposed class action filed by a plaintiff who alleges the company violated the Fair Debt Collection Practices Act (FDCPA) and California’s Rosenthal Fair Debt Collection Practices Act (RFDCPA). The plaintiff, a San Diego resident, alleges Zotec in December 2016 called and left a message for her regarding a medical services debt without disclosing in the call nor on its website that it is a debt collector.
“[The defendant’s] automated message never disclosed that the call came from Zotec or directly disclosed the call was an attempt to collect a debt,” the complaint reads. “[The plaintiff] was unsure of the caller’s identity because [the defendant] did not meaningfully disclose its identity in the voice message.”
