C. Tech Collections, Inc. is facing a proposed class action lawsuit alleging it sent a collection letter that failed to comply with the Fair Debt Collection Practices Act.
C. Tech Collections, Inc. is facing a proposed class action lawsuit alleging it sent a collection letter that failed to comply with the Fair Debt Collection Practices Act (FDCPA). The plaintiff in the case says the letter she received from the defendant instructed her to “MAIL ALL CORRESPONDENCE & PAYMENTS” to a physical address. The suit claims this language is misleading because it implies that if the plaintiff intends to dispute the debt, she must do so in writing. According to the complaint, the FDCPA contains “no requirement that the consumer dispute the debt in writing” and the defendant’s demand for written correspondence contradicts federal law.
